Consumer Terms & Conditions
As
a Customer you may open a Jio Money account and avail Jio Money
Services by accepting and subscribing the following terms and conditions
either by (i) clicking on I Agree button at the end of the application
form on the www.jiomoney.com
(Website); or (ii) physically executing the application form. Your
acceptance of these terms and conditions shall be unconditional and
without any limitation or qualification.
You also
declare that, the information provided and/or self-certified copies of
KYC documents submitted for registration and opening of Jio Money
account, Jio Money Wallet and Payment Bank Account, are correct and
valid and the same shall vest with RPSL and the Payment Bank Entity, as
the case may be. You confirm and consent that the documents provided
herein may be used by RPSL and/ or Payment Bank Entity to ensure
compliance with all relevant and applicable regulatory & KYC
requirements.
1. DEFINTIONS
i. RPSL Reliance Payment
Solutions Limited, a company incorporated in India having its registered
office at Court House, LT Marg, Mumbai is a regulated entity and holds
the license to issue semi-closed Prepaid Instruments.
ii. Consumer Application
Form/ CAF shall mean the form to be completed by the Applicant, signed
and to be submitted along with supporting documents, either online or on
the mobile application or physically at Agent locations and/or such
other locations, for availing the Jio Money Services.
iii. Applicant shall mean
you, an individual person above the age of 10 (ten) years, using an
operational mobile phone connection, who applies either on his own or
approaches Agents locations and/or such other locations, for availing
the Jio Money Services.
iv. KYC Guidelines of KYC
shall mean the Know Your Customer (KYC) guidelines as set forth by the
regulators.
v. Full KYC Account shall mean
a Jio Money Account operated as per the prescribed regulatory limits
for which the applicant has provided valid Proof of Identity, Proof of
Address and relevant KYC details as per the KYC guidelines issued by the
regulator.
vi. Low KYC Account shall mean
a Jio Money Account operated as per the prescribed regulatory limits
set forth by the regulator and for which the Applicant has only
submitted his name, date of birth and mobile number.
vii. Consumer shall mean an
Applicant who, upon submission of the CAF and upon completion of
necessary formalities, is found to be eligible by RPSL as per RBI
Guidelines, to avail the Jio Money Services and has opened a Jio Money
Account.
viii. Jio Money Wallet shall
mean the holder of all instruments either issued by RPSL or other
instruments added by the Consumer. The wallet can be accessed through
the Jio Money mobile application, on www.jiomoney.com or any other
channel facilitated & permitted by RPSL.
ix. Jio Money Account shall
mean a prepaid account either Low or Full KYC opened in the name of the
Consumer in order to enable the Consumers to avail the Jio Money
Services on their mobile phones and other channels, in compliance with
the RBI Guidelines.
x. Mobile PIN/ MPIN shall mean
a secret 4 digit numeric password that would enable the Consumer to
secure access and operate their Mobile money Account.
xi. Jio Money Services or
Services shall mean the prepaid and/or other services offered by RPSL by
operation of the Jio Money Wallet and /or the Jio Money Account.
xii. Minor(s) shall mean an
individual between the ages of 10 (ten) and 18 (eighteen) years.
xiii. Guidelines shall mean
the applicable guidelines, regulations, notifications and instructions
issued by RBI in relation to the operation of the Jio Money Account and
Jio Money Services and shall include The Payment and Settlement Systems
Act, 2007 & regulations made there under and Issuance and operation
of Pre-paid Payment Instruments in India (Reserve Bank) Directions,
2009, as amended from time to time.
xiv. Consumer Induced
Transactions or Transactions shall mean those that have been initiated
by the Consumer and/or the Consumer is the primary actor for the same.
xv. Payment Bank Entity shall
mean any affiliate or group entity of RPSL to whom the payment bank
license is or will be issued by the Reserve Bank of India.
xvi. Payment Bank Account
shall mean any and all bank accounts opened by the Customer with the
Payment Bank Entity excluding Jio Money Account.
xvii. "Merchant Establishment"
shall mean and include physical merchants, remote merchants including
e-commerce merchants and any other outlet who has been authorized by
RPSL to accept payment using Jio Money Wallet and/ or Jio Money Account. 2. GENERAL CONDITIONS
i. The Jio Money Services can
only be availed by an individual who is above the age of 10 (ten)
years. For Minors, only a Full KYC account shall be opened, for the
same, the Minors Guardians consent, KYC details and documents must be
submitted along with the corresponding details and upon such Minor
becoming an adult upon reaching the age of 18 years, KYC documents of
such person will replace the KYC documents of the guardian for
continuation of the Jio Money Account.
ii. The Consumer must have an
active mobile phone connection during the tenure of the Services
provided. The Consumer shall immediately inform RPSL in writing in the
event of any change, cancellation, termination or surrender of the
mobile phone connection.
iii. The Consumer confirms
that he/she does not hold any other Jio Money Account.
iv. The Consumer confirms that the Consumer is of sound mind.
v. The Consumer shall not use
Jio Money Services for any purpose that might be construed as contrary
or repugnant to any applicable law, public policy or for any purpose
that is contrary to RPSL policy or might prejudice the goodwill of RPSL.
vi. The Consumer hereby
authorises RPSL to provide Jio Money Services and open and maintain Jio
Money Account.
vii. RPSL shall issue and
operate the Jio Money Wallet and Jio Money Account and provide Jio Money
Services in accordance with these Terms and Conditions and relevant
Guidelines.
viii. The Consumer shall be
provided with Jio Money Services associated with a low KYC Jio Money
Account and within limits and restrictions as prescribed by regulations
until the successful completion of KYC in accordance with RBI
Guidelines. Upon successful completion of KYC verification the Consumer
shall be able to avail Jio Money Services associated with a full KYC
Account.
ix. For Consumers with a Full
KYC Account, the Consumer shall promptly inform RPSL about any changes
in his/her permanent and/or communication address and/or other relevant
KYC details and provide the supporting KYC document(s) that RPSL may
require from time to time.
x. To avail of the Jio Money
Services from any dealer location, the Consumers are required to only
approach the authorized retail dealers appointed by RPSL and having a
brick and mortar shop displaying the requisite brands and logos of Jio
Money Services.
xi. The Consumer shall be the
sole and exclusive owner of the Mobile PIN and/or password and/or Card
PIN. The Consumer shall accept sole responsibility for use,
confidentiality and protection of the Mobile PIN and/or password and/or
Card PIN. The Consumer shall not disclose the Mobile PIN and/or password
and/or Card PIN to any other person and shall not respond to any
unauthorized SMS/ e-mail/ phone call in which the Mobile PIN and/or
password and/or Card PIN is asked for. RPSL shall, in no manner
whatsoever, be held responsible or liable, if the Consumer incurs any
loss as a result of the Mobile PIN and/or password and/or Card PIN being
disclosed/ shared by the Consumer with any unauthorized persons or in
any other manner whereby the security of the Mobile PIN and/or password
and/or Card PIN is compromised.
xii. The Consumer shall not
assign or transfer Jio Money Account or the Services.
xiii. The Consumer must
ensure the availability of sufficient funds (including service Charges
thereon, if any) in the Jio Money Account before initiating any
Transaction.
xiv. The Consumer grants
express authority to RPSL for processing the Transactions and
instructions authenticated by providing the Mobile PIN and/or password
and/or Card PIN.
xv. Any information submitted
by the Consumer while using the Jio Money Services may be shared with
third parties by RPSL, inter- alia, to facilitate the provision of Jio
Money Services.
xvi. For Transactions
conducted at Merchant Establishments and/ or dealer locations, the
Consumer is responsible for satisfying himself with notifications that
the Transactions have been successfully completed. RPSL will endeavour
to inform Consumers of Transactions, however will not be held
responsible for notifications not reaching the Consumer. Any amount
transferred erroneously by the Consumer to any Merchant Establishment
shall not be refunded to the Consumer by RPSL under any circumstance.
RPSL shall not be liable for any unauthorized Transactions on the Jio
Money Account.
xvii. The Consumer shall
immediately call the Consumer call centre on the number listed on the
Website and register a complaint and shall subsequently also register
such complaint in writing or via email or using the form available
online or via the form available within the mobile app or through a
dealer in the event of any loss, and/or theft in/ of the mobile/mobile
phone connection/physical Jio Money card. RPSL shall not be liable for
any unauthorized Transactions on the Jio Money Account.
xviii. RPSL shall create an
escrow account with a bank of its choosing in accordance with RBI
Guidelines for maintaining the outstanding balances and creation of
necessary charge on such balance in the escrow account, as may be
required in relation to Jio Money Wallet in such escrow account. The
Consumer upon signing of these Terms and Conditions agrees that the
Consumer shall have no objection in this regard.
xix. The Consumer acknowledges
that any information provided to RPSL with the intention of securing
the Jio Money Account shall vest with RPSL (as the case may be), and may
be used by RPSL, at its discretion, for any purpose consistent with any
applicable law or regulation.
Subject to applicable laws and any
conditions imposed upon/ applicable to payment bank entity, the
customer hereby unconditionally and irrevocably grants his consent for
opening of a payment bank account with the payment bank entity and
hereby permits rpsl to share all information, data, kyc documents
including caf with the payment bank entity for opening of a payment bank
account. the customer also acknowledges that such information, data,
kyc documents and caf will be used by payment bank entity for compliance
with applicable regulatory and kyc requirements.
xx. The Consumer understands
that the funds loaded in the Jio Money Wallet will be utilized for the
products/ services offered by Jio Money. Refund of funds loaded in the
wallet will only be permitted in accordance with extant regulatory
guidelines.
ADDITIONAL CONDITIONS
i. The Jio Money Wallet is
issued to Consumers on an individual basis. No Consumer shall have more
than one wallet in his/her name.
ii. Jio Money Account will be
used only for transactions in Indian Rupees and not in any other foreign
currency.
iii. No cash redemption or
withdrawal from ATM machines is allowed from the Jio Money Account.
iv. RPSL makes no express or
implied warranty, guarantee, representation or undertaking whatsoever
regarding the Services, which are not expressly mentioned herein.
v. RPSL shall not be
responsible for any acts or omissions of any third party including
distributors/retailers/Merchants etc. with regard to Services which are
not expressly authorized by RPSL.
vi. RPSL shall not be liable
to the Consumer or any other person for any incorrect information
provided by the Consumer to RPSL pertaining to Jio Money Services, any
delays, loss of business, profit, revenue or goodwill, anticipated
savings, damages, fees costs, expense, etc. or for any indirect or
consequential loss, howsoever arising, on account of
unavailability/usage of Jio Money Services or otherwise.
vii. RPSL shall not be
responsible in any way for the products or services or for any site from
any Merchant Establishment from which they are purchased, or for any
charges, taxes or other duties relating to the Transactions. The
Merchant Establishments are solely responsible for all information in
relation to the products or services, for the products or services
themselves and their supply and sale to the Consumer. RPSL does
not endorse, promote, champion or warrant any goods and/or services that
might be bought/availed or proposed to be bought/availed using the Jio
Money Account.
viii. Any dispute with or
complaint against any Merchant Establishment must be directly resolved
by the Consumer with the Merchant Establishment. It is clarified that
neither RPSL shall be responsible or liable for any deficiency in goods
and/or services purchased using Jio Money Account. This exclusion of
liability shall apply even for goods and/or services made available by
RPSL under promotional schemes. Consumer is instructed to satisfy itself
regarding the quality, quantity and fitness of any good and/or service
before purchasing the same.
ix. The Consumer explicitly
agrees and consents that RPSL can share the Consumer data and the KYC
documents collected by RPSL with RPSLs group companies and affiliates
including with the Payment Bank Entity. Further, the Consumer confirms
that it has no objection and hereby authorizes RPSL to share such
Consumer Date including inter alia the certified copy of proof
of identity and address provided to RPSL with RPSLs group companies and
affiliates and these documents may be used by such entities to meet
their KYC compliance requirements (including in connection with opening
of any bank account by the Payment Bank Entity).
4. RESERVATIONS
i. The collection,
verification, audit and maintenance of correct and updated Consumer
information is a continuous process and RPSL reserves the right, at any
time, to take steps necessary to ensure compliance with all relevant and
applicable KYC guidelines issued by the regulator.
ii. RPSL reserve the right to
discontinue the Services and/or reject the CAF at any time at their
sole discretion, if there are discrepancies in the information provided
by the Consumer and the particulars provided by the Consumer in the KYC
documents do not match the details mentioned in the CAF. In such cases,
RPSL reserves the right to take appropriate action as it may deem fit
and proper without incurring any liability in any manner whatsoever.
iii. RPSL reserves the right
to suspend and/or discontinue the Jio Money Services or close the Jio
Money Account, at any time, without giving prior intimation to the
Consumer, for any one of the following reasons, including but not
limited to:
(a) any suspected violation of any rules,
regulations, orders, directions, notifications issued by RBI from time
to time or for any violation of these Terms and Conditions or compliance
with any applicable laws and regulations;
(b) Any discrepancy or
suspected discrepancy in the particular(s) or KYC documentation or CAF
provided by the Consumer or the same being unsatisfactory to RPSL;
(c)
Combatting potential frauds, sabotage, wilful destruction, threat to
national security or for any other force majeure reasons (more
particularly detailed in Clause 11 hereof) etc;
.
(d)
Technical failure, modification, up gradation, variation, relocation,
repair, maintenance and/ or any transmission deficiencies;
(e) If
the telecom service providers connection with which the Consumers Jio
Money Account is linked ceases to be operational or in the Consumers
possession or control on account of any reason whatsoever; and/ or
(f) Ineligibility of the Consumer under any criteria as mandated by RPSL.
However
prior to such suspension/ discontinuance of the Jio Money Services, the
Consumer, at the sole discretion of RPSL, shall be provided with the
ability to transfer and/ or utilize the balances lying in the Jio Money
Account.
iv. In the event of occurrence
of Transactions that may be construed as dubious or undesirable, RPSL
reserve the right to freeze operations in such Jio Money Accounts and
/or close the Jio Money Account including reporting to authorities as
may be required as per applicable regulations and as may be deemed fit
and proper.
v. RPSL reserves the right to
cancel the Transaction in case of any network failure. In case of
network failure or for any other reason beyond the control of RPSL,
there could be delay or failure to complete the Transaction. RPSL shall
not be responsible for any kind of losses that may occur due to such
delay of failure to complete Transactions.
vi. RPSL reserves the right
to reject the CAF and any documents of the Consumer at its sole
discretion. RPSL reserves the right to retain such CAF and documents and
photographs submitted along with it.
vii. Subject to applicable
laws, in case of NIL balance in Jio Money Account, the Customer may be
entitled to request RSPL for closure of such Jio Money Account. However,
it is clarified that in no event whatsoever, any amount from Jio Money
Account shall be withdrawn, redeemed or retuned to the Consumer unless
permitted by applicable laws.
5. CHARGES
i. Usage and operation of the
Jio Money Account is subject to payment of service charges prescribed
by RPSL on the Website and as set out on the Website (www.jiomoney.com)
from time to time. Charges shall be exclusive of service tax and
educational cess.
ii. The Consumer
unconditionally and irrevocably authorizes RPSL, to debit his / her Jio
Money Account from time to time with an equivalent fee and Charges
applicable for the issue and use of the Jio Money Account as and when
required by RPSL.
6. LIMITS The
Transaction and the Transaction limits for the operation of Jio Money
Account of the Consumers shall be set at the sole discretion of RPSL in
accordance with the applicable Guidelines as amended from time to time.
Such set Transactions and Transaction limits shall be communicated to
the Consumers by posting on the Jio Money Website (www.jiomoney.com).
7. INTENTIOANLLY LEFT BLANK
8. INDEMNITY
i. The Consumer shall be
liable to RPSL for losses, expenses or damages and agree to indemnify,
defend and hold harmless RPSL and /or the dealer harmless from any and
all claims, losses, damages, liabilities, costs and expenses, including
and without limitation legal fees and expenses arising out of or related
to its use or misuse of Jio Money Services, violation of these terms
and conditions or any breach of any representations, warranties and
covenants made by the Consumer.
ii. The Consumer shall
indemnify RPSL against any fraud or any loss or damage suffered by RPSL
due to the failure on the part of the Consumer to communicate correct
permanent or communication address and/or failure on the part of the
Consumer to communicate any change/alteration in the said permanent or
communication address.
9. CHANGE OF TERMS The
Terms and Conditions herein shall be subject to the
notifications/guidelines issued by RBI, from time to time. Further, RPSL
shall at their sole discretion, and with or without notice to the
Consumer, alter, modify or amend these Terms and Conditions from time to
time and the same shall be updated and displayed by RPSL on its Website
(www.jiomoney.com). The Customer is expected to keep himself/herself
updated with the amendments to the Terms and Conditions. Any transaction
done subsequent to the amendment of the Terms and Conditions will be
considered as Customers acceptance of the amended Terms and Conditions.
RPSL may modify, terminate and/or suspend Jio Money Services anytime
with or without prior notice, due to any changes in internal policies,
rules, regulations and laws set by relevant authorities/regulators.
10. SEVERABILITY If
any part of these Terms and Conditions are adjudged illegal or
inoperable for any reason, the same shall be severed from the remainder
of this document and only that portion of this document that is
specifically adjudged illegal or inoperable shall cease to govern the
relationship between RPSL and the Consumer.
11. OWNERSHIP AND PROPRIETARY RIGHTS The
Consumer agrees that he/she shall have no claims/rights of whatsoever
nature in the intellectual property rights arising out of and in
connection with Jio Money Account and Services thereto. The Consumer
further undertakes that he/she shall not attempt to modify, alter,
obscure, translate, disassemble, decompile or reverse engineer the
software underlying mobile application or create any derivative product
based on the software.
12. FORCE MAJEURE RPSL
shall inform the Consumer of the existence of a Force Majeure Event and
shall consult together to find a mutually acceptable solution.
Force
Majeure Event means any event due to any cause beyond the reasonable
control of RPSL and/or its partner Bank, including, without limitation,
unavailability of any communication system, breach or virus in the
processes or payment mechanism, sabotage, fire, flood, explosion, acts
of God, civil commotion, strikes or industrial action of any kind,
riots, insurrection, war, acts of government, computer hacking,
unauthorized access to computer data and storage device, computer
crashes, breach of security and encryption, etc.
RPSL shall not
be liable for any failure to perform any of its obligations under these
terms or the specific terms and conditions if the performance is
prevented, hindered or delayed by a Force Majeure Event and in such case
its obligations shall be suspended for so long as the Force Majeure
Event continues.
DORMANT ACCOUNT
i. RPSL may classify a Jio
Money Account as dormant if neither financial or non-financial Consumer
induced transactions have been carried out for a period of 6 (six)
months in that account.
ii. The Consumer maybe charged
maintenance charges upon expiry of 6 (six) months period unless
Consumer- requests RPSL to reactivate the Jio Money Account. In the
event that the Jio Money Account balance reaches such amount which is
less than the applicable account closure charges, due to levy of such
charges, the Jio Money Account shall be closed post intimation through
SMS.
iii. RPSL may in its sole
discretion issue a notice to the Customer about the status of the Jio
Money Account and if within a month from the date of the notice, the
Customer has failed to revive the account, may deny Services and / or
Transaction in the Jio Money Account of a Consumer, which has been
classified as dormant.
13. EXPIRY OF ACCOUNT The
Jio Money Wallet is valid for 12 months from the (i) date of
issuance/activation or (ii) last financial or non-financial transaction
conducted by you, whichever is later. Any unutilized balance remaining
in the Jio Money Wallet after the date of expiry will stand forfeited,
at the discretion of RPSL and after due communication through SMS or
other channel in accordance with the RBI Guidelines. Further, subject to
applicable laws and wherever applicable with prior approval of RBI, a
Jio Money Wallet and/ or Jio Money Account or any part thereof may be
assigned or transferred by RPSL to any person(s) including affiliates or
group companies of RPSL, and the Consumer hereby irrevocably and
expressly consents to the same.
In case of death of the Customer,
upon written request of the legal heir of the deceased Customer
accompanied by the death certificate of the Customer, appropriate
succession certificate identifying the legal heir as rightful owner of
the assets and liabilities of the Customer and any other document that
may be reasonably required by RPSL and details of the bank account in
which the funds are to be transferred. Subject to applicable law, RPSL
will close the account and after deducting applicable charges, transfer
the balance amount in the bank account so provided by the legal heir of
the Customer.
14. RESTRICTED REUSE OF SERVICE The
Consumer hereby acknowledges that he/ she will not reproduce, sell,
resell, duplicate, and copy any part of the service for any commercial
purpose.
15. LINK TO OTHER WEBSITES RPSL
may provide links to other websites that are maintained by third
parties. These links are provided for the convenience of the Consumer
only and the provision of these links does not mean that RPSL endorses
these websites or the products and services they provide. The Consumer
acknowledges and agrees that RPSL is not responsible and/or liable for
any information/ content or any products/ services available on these
third party websites.
16. QUALITY OF SERVICE Non-performance
of a service has limited liability on RPSL. RPSL is committed to
investigate the cause of non-performance with all parties involved.
However, no refunds will be made to your Jio Money Wallet balance unless
it is clearly established that RPSL was responsible. Redressal
mechanism for complaints along with the escalation matrix will be made
available on request. In case of any grievances, you may contact the
Nodal Officer at care@jiomoney.com or call Jio Money on 1800-891-9999 or
email care@jiomoney.com. Also
RPSL shall not be made a party to any dispute between the Customer and
merchant over any issue related to the transaction between the Customer
and the Merchant Establishment.
17. LIMITATION OF LIABILITY In
no event shall our total cumulative liability to the Consumer for any
and all claims relating to or arising out of the Consumers use of the
JioMoney Services, regardless of the form of action, exceed amount of
disputed transaction. In no event shall RPSL be liable to the Consumer
(or to any third party claiming under or through the Consumer) for any
indirect, special, incidental, consequential or exemplary damages
arising from the Consumers use of, or inability to use, the Website.
These exclusions apply to any claims for lost profits, lost data, loss
of goodwill, work stoppage, computer failure or malfunction, any other
commercial damages or losses, even if RPSL knew or should have known of
the possibility of such damages.
18. DISCLAIMER RPSL
may suspend or cease the operation of the website and/or mobile app for
any reason with or without giving any prior notice. RPSL reserves the
right to change the content on the website and/or mobile app, and/or
suspend or change the product or service offered by the website and/or
mobile app. The Consumer agrees that in any mentioned case, he/she will
use the website and/or mobile app at his/her own risk and RPSL is not
responsible for any loss or damage.
19. PRIVACY POLICY All
of the information that RPSL collects from the Consumer, such as
registration details, beneficiary account details and debit/credit card
information etc., is subject to its privacy policy. Please read its full
Privacy policy available at www.jiomoney.com.
20. ASSIGNEMNT RPSL
shall have the right to assign/transfer these presents to any third
party including its holding company, subsidiaries, affiliates,
associates and group companies. Further, RPSL and the Consumer agree
that this Agreement and terms and conditions herein can be novated
viz-a-viz RPSL with any affiliate, holding company, subsidiaries,
associates and/ or group companies of RPSL and the Consumer hereby
irrevocably consents to the same.
21. JUDICIAL RECOURSE This
Agreement will be governed by and construed in accordance with the laws
of the Republic of India without giving effect to any principles or
conflicts of law. The courts in Mumbai shall have exclusive jurisdiction
over any dispute arising from use of Jio Money. The Consumer agrees
that: This agreement is effective until terminated by RPSL and RPSL
reserves the right to terminate this agreement. RPSL may move, change,
suspend or end any part of the services provided by RPSL. RPSL reserves
the right to terminate Consumers membership and remove all the content
in his/ her account for reasons, including, but not limited to:
Violation of any governing policy or law.
